We expressly disclaim liability for service interruptions, delays, or errors caused by force majeure events including natural disasters, pandemics, government actions, or internet outages.

Eggvy does not represent or warrant that:

• Imported transaction data will be accurate, complete, or current;
• Spending categorizations, budget allocations, or insights generated by the App will reflect your true financial circumstances;
• Sponsored product eligibility results (e.g., prequalification notices) will be accurate or will guarantee approval by third-party financial partners.

2.3 Potential inaccuracies

Errors, delays, or omissions may result from:

• Technical malfunctions or downtime at financial institutions;
• Incomplete or outdated data feeds from Connectors;

Any reliance you place on the information provided by the Services is strictly at your own risk. Eggvy disclaims liability for actions you take (or fail to take) based on Service outputs.

3.2 Disclosure of compensation

Eggvy does not:

• Function without interruption;
• Be error-free or free from defects;
• Always be available at specific times or in specific jurisdictions.

4.2 Potential service disruptions

Access to the Services may be suspended or interrupted due to:

• Scheduled maintenance or upgrades;
• Unscheduled outages, server failures, or software errors;
• Internet, mobile network, or power outages;
• Denial-of-service attacks, cyber intrusions, or other malicious acts.

4.3 Device compatibility

Eggvy does not guarantee that the Services will operate on all devices, operating systems, or browsers. It is your responsibility to ensure your device meets the minimum technical requirements.

4.4 User obligations

You are responsible for:

• Keeping your device secure and up to date;
• Maintaining a reliable internet connection;
• Protecting your login credentials.

4.5 Technology risks inherent to digital services

By using the Services, you acknowledge the inherent risks of digital applications, including but not limited to:

Eggvy provides insights, categorizations, and spending recommendations based on algorithms and imported transaction data. These outputs are estimates only and may not reflect your full or actual financial circumstances.

5.2 Financial outcomes

Eggvy shall not be responsible or liable for:

• Declined credit applications or adverse lending decisions;

5.3 Third-party conduct

Eggvy disclaims liability for damages caused by:

• Financial institutions' refusal to share, update, or correct account data;
• Financial Partners' actions, omissions, or product terms.

5.4 Consequential losses

To the maximum extent permitted by law, Eggvy shall not be liable for:

• Loss of profits, revenue, or goodwill,
• Business interruption,
• Any reliance losses caused by actions taken on the basis of Service outputs.

5.5 Jurisdictional carve-outs

Nothing in this Disclaimer excludes liability where prohibited by law, such as:

• Fraud or fraudulent misrepresentation;
• Consumer rights that cannot legally be disclaimed under applicable law.

6.1 Non-permitted uses

7.1 Not a regulated entity

Eggvy provides technology tools to help users manage personal finances but is not itself:

• A bank, credit union, or depository institution regulated by the FDIC, OCC, or Federal Reserve;
• A money transmitter or money services business under the U.S. Bank Secrecy Act, FinCEN rules, or equivalent state statutes;
• A lender, loan broker, or credit repair organization under U.S. state or federal law;
• An investment adviser or investment company regulated under the U.S. Investment Advisers Act of 1940 or Investment Company Act of 1940;
• An insurance provider or producer licensed under state insurance codes;

Eggvy does not target or provide services to EU/EEA/UK users and therefore is not subject to GDPR or other foreign financial intermediary regulations.

If you apply for or purchase financial products (e.g., loans, credit cards, or insurance) through Eggvy, those products are provided by independent third-party financial institutions ("Financial Partners"), which are subject to their own licensing and regulatory obligations.

Eggvy does not warrant or guarantee that Financial Partners comply with applicable laws or regulations. You must review their terms, disclosures, and licenses directly.
